A Derry MLA has called for a legal check of “zero hour” contracts as well as sick benefit and holiday pay of workers employed part-time contracts.
Pat Ramsey, the SDLP’s Employment and Learning spokesperson, has submitted a motion to the Assembly calling on the Employment and Learning Minister to clarify the legal status of such contracts.
Mr Ramsey said a recent employment tribunal in England had brought the opportunity to address concerns in what was becoming a “more frequent employment status.”
The Office of National Statistics says there are as many as four per cent of the entire population on “zero hour” contracts, a figure Mr Ramsey believes is inaccurate.
He said: “I suspect the number is much higher. In this economic climate we know employers are seeking a more flexible workforce, however we must ensure as best possible that the rights of workers are protected and that any legal issues around employment status are clarified to ensure that employers and employees are clear on their rights and responsibilities
He added: “A case has recently been taken to an Industrial Tribunal in England questioning the legal employment status of a ‘zero hour’ contract and it is only prudent that we endeavour to analyse all the relevant input from stakeholders locally and have the Department publish details of the legal position.”
He concluded: “It is only fitting now given the Department of Employment and Learning is undertaking a review of local Employment Law and I hope that a fruitful debate can be held whereby we listen to the business community and to other stakeholders to gain an idea of the impact of ‘zero hour’ contracts both positive and negative.”
