A man accused of a number of drugs offences, including the possession of cannabis with intent to supply, has been banned from using a mobile phone as one his bail conditions.
Kevin Doherty (29) was charged with a number of drugs offences when he appeared at the local Magistrates Court.
Doherty, of Ardgrange in the Foyle Springs area of Derry, was charged with the cultivation cannabis, possession of cannabis and possession of cannabis with intent to supply on 2 January last.
He is further charged with the possession of cannabis and possession of cannabis with intent to supply yesterday, 15 January.
The court heard Doherty admitted to having £2,000 worth of the drug discovered by police in a car in which he was a front seat passenger when it was stopped and searched by police yesterday.
The court was told the accused had been on police bail in relation to the discovery of the cannabis plants on 2 January.
Applying for bail, defence solicitor Paddy MacDermott said the drugs involved were on the lower scale and were available in a number of states in the US.
Pointing out his client had no record for similar offences, Mr MacDermott said Doherty would be prepared to adhere to whatever bail conditions were imposed on him.
In response, Resident Magistrate Barney McElholm said: “He does not appear to pay much attention to bail conditions imposed by police.”
However, Mr McElholm added he was prepared to give the accused “one opportunity.”
Releasing Doherty on his own bail of £1,000 and imposing a curfew between 6.30pm and 6.30am, Mr McElholm ordered the accused to reside at his address in Ardgrange, be electronically monitored (tagged), report to police at Strand Road once a week and not to have possession of or use any mobile phone.
Doherty was also ordered to submit to a drugs test, not to take non-prescription drugs and not to consume alcohol.
He was also instructed to not make contact with the driver of the car in which he was a passenger when the drugs were uncovered.
Ordering Doherty to return to court again on 13 February next, Mr Elholm said he would be remanded in custody if there were any breaches to his bail conditions.
