She says that the Council of Europe’s concerns about wider failures around legacy and the lack of progress on legislation following the Stormont House Agreement must also be heeded.
Mr Finucane was shot dead in front of his family by UFF gunman on Sunday, February 12, 1989, at his home in north Belfast.
Said Cllr Durkan: “More than 30 years on, the Finucane family deserve nothing less than a full fact-finding public inquiry into this murder.
“It is shameful that the British Government has repeatedly refused to establish such an inquiry in spite of rulings by the European Court of Human Rights and the UK Supreme Court.
“This refusal by government to act is a gross violation of human rights, a flagrant breach of duty under international law, and an insult to the family.
“The Council of Europe will now be examining the British Government’s approach to the case and the ongoing processes and measures therein. This scrutiny is necessary and warranted.
“The British Government must set up the Finucane Inquiry as soon as possible and must ensure that all legacy cases will be addressed with due urgency and in full compliance with human rights,” she added.
