Said Cllr: “We are acutely aware of the increasing backlog of what were already packed Court lists. Even before the pandemic, court users often found themselves travelling outside of Derry due to space limitations in Bishop Street.
“As with other services, the justice system has had to make adaptations.
“Of course, we can see that remote evidence may be appropriate in cases regarding vulnerable witnesses, with a role for hybrid hearings on a more permanent basis.
“However, for most Court business, virtual hearings do not work, and in fact court by sightlink is a barrier to the justice system for so many people.
“There are cases where an in-person hearing is just essential.
“Because of the pandemic, we have public spaces that are not going to be in use for some time.
“So let’s find a way to meet this important need- the need for people to access the fundamental right to justice.
“I have been making representations around the need for Nightingale courts in Derry.
“I have seen first-hand how well the set-up of the only Nightingale court at the ICC in Belfast has been working.
“However, we need temporary courts operating outside of Belfast too. It is unacceptable for people in the North West to be expected to wait indefinitely for a day in court, or for example a welfare appeal.
“Nor is it ideal for people to have to make a journey to Belfast during the pandemic when public transport services have been reduced.”
Miss Durkan concluded: “I am glad that following earlier requests, relevant officers have been engaged in discussions. Potential suitable venues have been identified for consideration by NICS.
“I will be seeking an update on progress. Regional balance must apply to all public services, and there are also equality issues at stake. “
